What is Texans Helping Texans?

Texans Helping Texans Recover is a big data organization that is pursuing legal action against Texas energy providers.

Texans Helping Texans was started by CirclesX, whose state-of-the-art energy data monitoring services and analysis produced clear evidence of malfeasance and wrongdoing by the energy companies. CirclesX (and its predecessor company) is a local energy data analytics software company, based in Houston for the past 20 years.

Today, CirclesX is working with dozens of community and business partners to expand the reach of Texans Helping Texans and maximize the good we can do for our state.

Members of the CirclesX platform may be eligible to assign their legal claims resulting from Winter Storm Uri 2021 to the Texans Helping Texans Recover.

What is a custom legal action or Multi-District Litigation (“MDL”)?

Unlike a “Class Action”, a Custom Legal Action or Multi-District Litigation (“MDL”) allows for each claim holder to get their claim evaluated individually by the court.  The Custom Legal Action therefore gets a much higher possible settlement for the claim holder.    This Custom Legal Action method provides strength in numbers for all of the people harmed, especially beneficial when facing large corporations, or businesses that have a long reach.

These types of lawsuits support individual claimants who would otherwise not have the means to pursue a claim on their own. In this case, CirclesX and Texans Helping Texans Recover are paying all legal and operational costs associated with the lawsuit, so you and other Texans who were harmed by losing fuel or power during Winter Storm Uri can join together to demand reparations from the energy companies. Most individuals cannot afford to pursue any type of litigation on their own, and no one possesses the evidence we do to win this case.

If you join us, there is a very realistic chance of a positive outcome and a tangible, meaningful payout to all claimants with accepted claims. Texans Helping Texans will split the net proceeds with claimants 50/50 - half goes toward recovering your claim, and the other half goes to CirclesX for bearing the legal cost and financial risk of running the legal action.

What does it mean to sell or transfer my claim?

Assigning your claim means that you are selling Texans Helping Texans the right to sue for your loss. In exchange for 50% of the net proceeds, you agree not to pursue independent legal action on your claim and instead allow us to fight the legal battle.

How much money can I get back?

Texans Helping Texans Recover will split net proceeds with claimants 50/50. What that means is that we will split the damage award after the cost of pursuing the class action is covered.

A simple example of how it works when you sell your uninsured claim (the example below is not a predicted outcome or any promise of an outcome):

  • $5,000 verified claim costs sold and assigned from Claimant “John Smith” to Texans Helping Texans Recover

  • The case is successful and $5,000 is paid out to Texans Helping Texans Recover

  • $1,000 is deducted to cover legal costs (this is not predicted, only an example)

  • $2,000 is paid to Claimant John Smith, and $2,000 is paid out to CirclesX (this is not predicted, only an example)

  • If no settlement is reached, it is possible you may not receive any payout. In that case, CirclesX will lose the investment they spent in pursuing the custom legal action, but there is no financial out of pocket risk to you other than giving up your right to separately or individually file a claim.

How does CirclesX make money on this?

CirclesX and our affiliates have invested in our own claim with large energy database systems built over 20 years.  We are also willing to front the legal and discovery cost involved with the case which will be expensive and costly.  In taking these risks and buying your claim, we will lose if the case is not successful.  If the case is successful, 50% of the net proceeds recovery of your ORIGINAL CLAIM will be paid to you and 50% of the net proceeds recovery will go to CirclesX to cover our software, business, legal and other costs.  You have no out of pocket cash cost risk to join the project as an existing platform member other than giving up your right to separately or individually file a claim.  You are only forgoing the right to pursue your uninsured claims separately on your own.

What did these energy companies do?

Winter Storm Uri brought devastation to thousands of Texas residents and businesses across our state – adding up to more than $200 billion in losses. And an enormous percentage of these losses were completely avoidable.

Do I have a conflict if I already filed an insurance claim to cover this loss?

You should pursue your insurance claims as you normally would. You are only assigning claims your insurance did not pay on to the Texans Helping Texans Recover. The effort will only attempt to cover losses your insurance company did not pay for or for losses not covered by your insurance. You should pursue all your insured claims with your insurance company. You may proceed with your insurance company for insured claims and with the Texans Helping Texans Recovery Fund for claims your insurance did not pay on.

Is there a time limit to sell and assign my claim to be included in Texans Helping Texans Recover?

Due to increased demand, we have created a new recovery fund with a claim deadline of December 31, 2023.  Claims sold and assigned before that date will have priority.  Claims after that date may not be accepted.

Can I hire a law firm to handle my claim?

While you can hire any law firm you chose, law firms do not necessarily have the data required to prove market manipulation claims.  In fact, law firms are licensing our data and assigning their claims to the Texan Helping Texans Recover for these unique claims. Even with our data and legal experts, we can’t guarantee a favorable outcome.

Is my data confidential?

Yes, your data will only be used in accordance with the claim and case and software to enhance the claim on an opt in basis.  

If I have legal questions what should I do?

If you have questions, you should speak with your own counsel, legal advisors or advisors who can give you input on how best to proceed.  CirclesX is not a legal advisor or financial advisor.

How often will I be updated on the status of the potential 50% net proceeds recovery of my claim?

The website system is updated daily with any updates.  Some days, no new information will be known, but the most current information will always be available on the website through your secure account.

Am I agreeing to the platform Terms of Use?

Yes, the CirclesX Platform and THTRF sub-project have rules of integrity such as users confirming their identity, user verification, warranting not to abuse the system or platform by doxing or hacking and proof of any claims among other things. CirclesX may restrict a users access to the system at any time if the user has proven to violate the rules of the platform Terms of Use.

Is my data confidential?
